Abstract

While the European regulation of digital markets and services gets implemented, the European Parliament has started this summer examining AI regulation. Their approach focuses on assessing the level of risks associated with each algorithm or system. This ex ante regulation is similar to authorizations of new treatments, as granted by the US Federal Drug Agency or comparable entities in other countries. Unfortunately, such an approach ignores dynamic interactions and evolutions in human behavior induced by AI.

Instead, the author proposes to draw inspiration from Central Banks and financial market authorities. He argues for continuously monitoring essential algorithms in real time, while maintaining a medium to long term perspective. This will foster trust and responsible innovation. It can also introduce a democratic oversight of social and environmental targets in AI development.
